Court Proceedings: Sonja Madzikanda and Mother Remanded Over Cyberbullying Allegations

The Harare Magistrate’s Court has remanded Sonja Madzikanda and her mother, Tabitha Madzikanda, in custody pending a ruling on their bail application. The pair appeared before Magistrate Nyaradzo Manokore facing charges of cyberbullying and harassment.

The case centers on allegations of unauthorized data access and the distribution of sensitive media, with the court currently reviewing the State's shifting position on the defendants' bail eligibility.

The Legal Breakdown

The defendants were brought before the court following a complaint by businessman Mr. Wicknell Chivayo. The charges stem from the Data Protection Act, specifically focusing on cyberbullying and the unlawful publication of private data.

Key Allegations

The State alleges that Sonja Madzikanda unlawfully accessed private media from the complainant's device and, along with her mother, facilitated its viral distribution on social media platforms.

In a turn of events, the State (represented by Monalisa Magwenzi) indicated it was no longer opposed to bail. However, Magistrate Manokore questioned this change, as the initial court papers indicated a strong intention to oppose bail.

Matter Rolled Over

To ensure a thorough review of the proceedings and the sudden change in the State's stance, the Magistrate rolled the matter over to allow for a formal ruling on the bail application.

A significant portion of the State's case involves the use of Artificial Intelligence (AI). It is alleged that the pair used AI to generate photographs purporting to show Chivayo associating with South African President Cyril Ramaphosa.

Claim of Distress

The State argues that these published photographs and videos caused the complainant "substantial emotional distress and humiliation," leading to the current criminal charges.

Current Status

The court is expected to deliver its ruling on the bail application today.

Justice in Progress

As the case unfolds, the focus remains on the interpretation of the Data Protection Act and the use of modern technology in domestic and legal disputes. Both defendants remain in custody pending the court's decision.
